SALE OF PRODUCTS THROUGH THIS WEBSITE

Contracts are made and accepted subject to these Conditions of Sale and the Website Terms and Conditions Of Use incorporating the General Conditions of Sale.
In these terms and conditions:

“Goods” refers to the wood plantation shutters as supplied by the California Shutter and Blind Company Limited;

“Our” refers to “We” or “Us”;

"We and Us" means The California Shutter and Blind Company Limited either alone or together with you, as the context requires;

"Working day" means every day of the year except weekends, and English statutory and public holidays;
"You" means the person ordering goods and/or using this website subject to these terms and conditions.

PLEASE NOTE: All contracts for the sale and purchase of goods made through this website are between you, acting as a consumer, and The California Shutter and Blind Company Limited. You shall have no contractual relationship with B&Q plc as a result of any purchases made through this website and B&Q plc will bear absolutely no liability whatsoever in relation to any claims actual or contingent arising out of, or in contemplation of, the sale of products through this website. All customer queries, complaints, correspondence and any other issues whatsoever relating to the sale of products through this website are to be addressed to The California Shutter and Company Blind Company Limited and not to B&Q plc.

1. Our Contract
1.1 This website constitutes an online shopping facility for You to purchase wood plantation shutters at retail price for the purpose of self installation. A contract between You and Us shall be deemed legally binding upon acceptance of Your order. Acceptance of Your order will be confirmed by an e-mail which will be sent to You upon receipt of Your order. For the avoidance of doubt, purchases made on this website shall not be made from or through B&Q Plc and no contractual relationship between You and B&Q Plc shall arise from Your use of this website.

2. Price
2.1 The price as detailed on the order summary section will be the price payable for the Goods. This price includes all applicable UK taxes and unless otherwise indicated, includes a delivery charge to the mainland UK.

2.2 Upon acceptance of Your order as per section 1.1, We shall debit the price of the Goods from Your chosen method of payment.

3. Order Cancellation by You
3.1 Due to the fact that all Goods are custom manufactured to Your requirements and specification and are deemed non resaleable, We cannot cancel any orders at your request once the order has been accepted by Us as per clause 1.1.

3.2 Cancellations can be accepted prior to Your order confirmation e-mail being sent.

4. Order Cancellation by Us
4.1 In certain situations it may be necessary for Us to cancel Your order. This may be due to a production issue with Our manufacturing plant, or other circumstances outside of Our control. In the event of this occurring We will notify you via e-mail and re-credit all money debited at order placement.

4.2 We will not make any compensation payment in the event of order cancellation by Us.

4.3 We will have no liability whatsoever to You for any damage or consequential loss caused by Us cancelling Your order in accordance with clause 4.1 above.

5. Product Description
5.1 We have taken all reasonable measures to ensure that the information as displayed on this website is accurate, correct and true. If You are in any doubt about the information as communicated by Us, please contact Our support team prior to order placement.

5.2 As with all wooden products, natural shading differences may occur between the colours as displayed and that seen in the finished Goods as purchased by You. We cannot guarantee that the appearance and/or colours of products shown on this site exactly reproduce the appearance and/or colours of the physical products themselves. Natural products may show some colour variations. We cannot accept any returns or authorise any refunds due to Your disappointment resulting from natural shading variations where there is no fault with the Goods.

5.3 Colour variations do occur between monitors. As You are viewing the product online, we therefore recommend that You request a sample slat from our website before as We cannot be held liable for any loss due to variations between colours as perceived when viewed online and the colour of the finished product when perceived in person and we cannot accept any returns or authorise any refunds in connection with such differences.

5.4 All goods should be fully inspected by You prior to installation. You must check that the goods are in accordance with Your purchase order both for measurements and design prior to installation. Your ability to exercise any remedies or rights which You may have as a consumer could be diminished by any failure to properly inspect the goods prior to installation and You may be in breach of Your duty to mitigate any losses You suffer if You install a product when the prior inspection of it would have shown that it does not meet Your order requirements.

6. Product Measurements                                                                                                                                                    6.1 CSBC Ltd has done everything in its power to ensure that the website provides as much information as possible to assist You in achieving correct measurement of Your window for Your window dressings. Please refer to Our website for instructions regarding measurements. Please note that if You are in any doubt about the measurements taken, please contact Our support team prior to order placement.

6.2 If the measurements You supply to us vary from Your actual requirements we cannot accept any liability for any consequential losses either direct or indirect and cannot accept return of the Goods or issue a refund in respect of the Goods, provided that the Goods have been manufactured in accordance with the measurements You supplied to us.

6.3 The design image generated by Our site (when You submit your dimensions) is for illustration purposes only. The image may not be an exact representation of the number of slats or size of rail you will receive in your actual order. If you require exact confirmation of these design details prior to production please contact Our support team before submitting your order.

6.4 On receipt of your order Our staff will call You to confirm You have understood Our measuring guides. For all Inside Mounted Shutter orders we advise You that a standard deduction of 2mm from Your submitted width and drop dimension is made, this is for ease of installation. (You are given the choice not to have these deductions made).

6.5 Manufacturing tolerance levels of overall panel and frame specifications are plus or minus 2mm, and the product will not be considered defective if falling within the size range. Warp on any component part, vertical or horizontal, shall not exceed 1mm per 300mm.

6.6 Horizontal middle rail location: This location may be off by half a louvre.

  • For 47mm louvre can be off by +/-19mm.
  • For 64mm louvre can be off by +/-25mm.
  • For 89mm louvre can be off by +/-38mm.
  • For 114mm louvre can be off by +/-51mm.

7. Delivering Your Goods.
7.1 We will despatch Your order as soon as the Goods are ready. While We quote a lead time of 7 – 8 weeks for delivery of Your Goods, these are estimates only and not contractual terms. While We make every effort to ensure that delivery times are met We cannot accept responsibility for any damage or consequential loss arising out of any delay.

7.2 On delivery of the Goods please check that the delivery boxes are in good condition. You must sign the courier’s delivery note and if damage has occurred ensure this is noted on accepting the goods. The California Company will not take any reasonability for goods damaged in transportation, which have not been signed for as ‘damaged’.

7.3 Free delivery and all stated delivery prices apply to Mainland UK postcodes only. Delivery to Scottish Highlands / Off Shore & Channel Islands, NI, Eire and Europe are deemed outside Mainland UK and will incur some additional charges. Please contact our team for prior confirmation or submit order through website and we will contact you to confirm charges.

7.4 Ownership & title of the goods will pass to You upon delivery.

8. Liability
8.1 As the product is installed by You or a third party, We cannot accept any responsibility for damage made to the product at installation. You are provided with full instructions however if You do not understand any part of the procedure please contact Our support team for help before You attempt to install.

8.2 If You choose to pay a third party for the purpose of installing the goods and problems arise during installation We will not accept any liability for the work carried out by such third parties.

8.3 We give no warranty as to the fitness of the product supplied for any purpose other than that of an internal window dressing. Other installation and uses are at Your own risk, are not advised and are not what the Goods are intended for.

9. Defective Goods

9.1All Goods as supplied by CSBC are covered by a guarantee against defects in craftsmanship or materials. The guarantee period is as follows:

Plantation Shutters 36 Months
Quickfix Temporary Blinds 3 Months

This guarantee period begins when the Goods are delivered to You. If Your Goods arrive damaged or there is a defect in manufacturing, You must report this to Us as soon as reasonably practicable and in any event within 28 days. Any issues You report to Us need to be accompanied by photographic evidence. Following notice from You of the problem, we will advise You on how the matter will be resolved. You must also ensure that the condition of the goods is not altered so that they can be properly inspected by Us if necessary and You should not attempt to install the Goods (see term 5.4 above).

9.2 Return of defective Goods will only be accepted with prior notification. In the first instance, You must contact Our support team via e-mail or telephone to explain the nature of the problem. In the event that the Goods are defective We will arrange for collection of the Goods via courier at Our expense. If the Goods are deemed defective due to misuse by You or are not suitable due to incorrect measuring or ordering (see term 6.3 above) then all related costs of shipping will be passed on to You.

9.3 If the Goods are deemed defective We will offer You replacement of the Goods or a desired alternative as deemed by us.

9.4 Goods that have been used in unsuitable conditions (excessively humid or in a high moisture environment or using interior shutters in an exterior environmen) or having been subjected to irregular use may not be deemed acceptable for return as detailed in clauses 9.1- 9.3.

10. Payment Security
10.1  All payments made through this website are processed securely. Please see our Security policy for further details.

10.2 Your details (excluding your credit/debit card details) may be shared with our partner B&Q Plc at their request. For further details please see our Privacy policy.

11. Governing Law
11.1 This contract is subject to English Law and the exclusive jurisdiction of the English courts.

11.2 If any part of these terms and conditions is found to be unenforceable as a matter of law, all other parts of these terms and conditions shall not be affected and shall remain in full force and effect.

12. If You the customer decide to use the cut out templates to assist with measuring please note the following
It is the responsibility of You to ensure You follow Our guidelines in printing the templates correct to scale. This can be done by selecting PAGE SCALING set to NONE when printing from Our measure guide. This ensures that the frame profile templates are printed to the actual frame size. We cannot accept liability for any discrepancies in the shutters or failure to conform to desired measurements which are due to incorrect printing of the templates in contravention of the guidance in this clause.

We reserve the right to change these Terms and Conditions without prior notice.
These terms and conditions are in addition to and do not affect your statutory rights.
